RECOMMENDATION(S):Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached professional services agreement with Foothill Heights Care Center, LLC regarding the provision of long-term residential skilled nursing and mental health treatment services to adults with severe and persistent physical and mental illnesses in an amount not to exceed $2,254,000 for the period of Jan. 1, 2026 through June 30, 2029; and
2. Authorize the Department of Health and Human Services (DHHS) - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement Foothill Heights Care Center, LLC, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one fully executed electronic copy of the attached professional services agreement with Foothill Heights Care Center, LLC to the DHHS - Contract Unit for further processing.

DISCUSSION:
The Humboldt County DHHS - Behavioral Health, in conjunction with the Humboldt County Public Guardian’s Office, utilizes a variety of placement options to provide long-term mental health treatment services to mentally ill clients who require assistance in locked and unlocked facilities. It is important for the placement team to have a variety of treatment options because vacancies and client needs fluctuate.
Foothill Heights Care Center, LLC operates a locked skilled nursing facility located in Pasadena, California. Foothill Heights Care Center, LLC’s skilled nursing facility provides medical and mental health treatment services to individuals over 18 years of age who require 24-hour monitoring in a residential setting due to the severity of their physical and mental illnesses. All of the medical and mental health treatment services provided at Foothill Heights Care Center, LLC’s skilled nursing facility are designed to transition clients to independent living within their communities, and are delivered with a wellness focus, which includes, without limitation, concepts of recovery and resilience.
Clients placed at Foothill Heights Care Center, LLC’s skilled nursing facility are monitored by the County of Humboldt’s multi-disciplinary Strategic Assistance for Adult Recovery Interventions (SAFARI) committee. The SAFARI committee authorizes services, determines the appropriate level of care and monitors client needs in the community upon discharge. When an initial placement at Foothill Heights Care Center, LLC’s skilled nursing facility occurs, transitional plans for less restrictive care are put in place, and reviewed monthly, in order to transition clients to community living as may appropriate.
The attached professional services agreement will allow up to six eligible DHHS - Behavioral Health clients to receive skilled nursing and mental health treatment services at Foothill Heights Care Center, LLC’s skilled nursing facility for the period of Jan. 1, 2026 through June 30, 2029. It should be noted that the attached professional services agreement with Foothill Heights Care Center, LLC comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
This contract fulfills the department’s mandate to connect to Lanterman-Petris-Short (LPS) Conserved community members. Behavioral Health is under a mandate to provide appropriate housing and supportive services to individuals who have been designated by Humboldt County office of the Public Guardian as conserved under the LPS Act of the California Welfare and Institution Code sec. 5000 et seq.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the Chair of the Board to execute, the attached professional services agreement with Foothill Heights Care Center, LLC regarding the provision of long-term skilled nursing and mental health treatment services to adults with severe and persistent physical and mental illnesses for the period of Jan. 1, 2026 through June 30, 2029. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with Foothill Heights Care Center, LLC, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed skilled nursing and mental health treatment services.

The attached professional services agreement with Foothill Heights Care Center, LLC has a maximum amount payable of $2,254,000 for the period of Jan. 1, 2026 through June 30, 2029. In no event shall the maximum amount paid under the attached professional services agreement with Foothill Heights Care Center, LLC exceed $322,000 for fiscal year (FY) 2025-26 and $644,000 per FY for FYs 2026-27 through 2028-29. However, in the event local, state or federal funding is reduced or eliminated, the County of Humboldt may reduce the above-referenced maximum amount payable or terminate the attached professional services agreement with Foothill Heights Care Center, LLC in its entirety.
Expenditure appropriations related to attached professional services agreement with Foothill Heights Care Center, LLC have been included in the approved FY 2025-26 budget for DHHS - Behavioral Health Adult Services budget unit 1170-496. Funding for the attached professional services agreement with Foothill Heights Care Center, LLC is available through Behavioral Health Realignment revenues received by DHHS - Behavioral Health.
STAFFING IMPACT:
Approval of the attached professional services agreement with Foothill Heights Care Center, LLC will not impact current staffing levels.
OTHER AGENCY INVOLVEMENT:

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached professional services agreement with Foothill Heights Care Center, LLC regarding the provision of long-term skilled nursing and mental health treatment services to adults with severe and persistent physical and mental illnesses. However, this alternative is not recommended since it would require DHHS - Mental Health to place clients at inpatient facilities which will be more costly and may not provide the appropriate level of treatment for such clients.
