RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Adopt the attached resolution which authorizes the Humboldt County Department of Health and Human Services (DHHS) - Public Health Director, or a designee thereof, to accept funding made available through the California Department of Justice Tobacco Grant Program in the amount of $203,276; and
2. Authorize the DHHS-Public Health Director, or designee thereof to execute the attached Tobacco Grant Program Grant Services Branch - Local Assistance Division of Operations Memorandum of Understanding; and
3. Authorize the DHHS-Public Health Director, or designee thereof to execute all subsequent amendments, and any other agreements, certifications, attestations, and documents directly related to the grant agreement, after review of County Counsel and Risk Management; and
4. Direct the Auditor-Controller to post the attached supplemental budget in the amount of $65,787 in Fiscal Year (FY) 2024-25 budget in Fund 1175, Budget Unit 411, Hazmat Program (4/5 Vote Required); and
5. Direct the Clerk of the Board to return one, (1) fully executed certified copy of the attached resolution, to the Department of Health and Human Services-Public Health, Division of Environmental Health for the submission to the California Department of Justice.

DISCUSSION:
Tobacco use cessation and prevention directly relate to several DHHS-Public Health, Community Health Improvement Plan measurables, and youth-targeted prevention has been shown to reduce community addiction. This item accepts $203,276 in funding made available through The California Healthcare Research and Prevention Tobacco Tax Act of 2016 (Proposition 56) and administered by the California Department of Justice to support local efforts to reduce illegal sale of tobacco products to minors in the county. The three-year grant would cover the implementation and enforcement of the Tobacco Retailers License program between fiscal years 2024-2025 to fiscal year 2026-2027.
The activities in this grant agreement include the enforcement of local ordinances and state laws related to illegal sales and marketing of tobacco products, including e-cigarettes, to minors. Enforcement efforts will include activities such as retailer compliance checks; tobacco retail license inspections; enforcement of flavor ban laws and ordinances; preventing illegal online sales and marketing, including use of door-to-door delivery services; retailer training programs; public education outreach.

Narrative Explanation of Financial Impact:
The attached resolution will allow the DHHS, Public Health Director, or a designee thereof, to accept California Department of Justice, Tobacco Grant Program funding in the amount of $203,276 for DHHS-Public Health Fund 1175, Budget Unit 411, Hazardous Materials Program. This agreement was not anticipated in the FY 2024-25; therefore, a supplemental budget is requested in the amount of $65,787. The funding amount for future fiscal years will be included in the annual budget cycle.
STAFFING IMPACT:
There will be no impact to current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve the grant agreement with the Department of Justice. This is not recommended as it would cause a loss of funding necessary to support local ordinances and state laws related to illegal sales and marketing of tobacco product.
