RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve Cooperative Agreement No. 25-0553-000-SA, known as the Apiary Protection Program contract with the California Department of Food and Agriculture (CDFA); and

2.                     Authorize the Chair to sign the original agreement, and direct the Clerk of the Board to return all signed copies to the Agricultural Commissioner’s office for further processing; and

3.                     Approve attached supplemental budget for budget unit 1100-261 in the amount of $1,000 (4/5 Vote Required); and

4.                     Grant a waiver from the provisions of the Nuclear Free Ordinance.

DISCUSSION:

The Agricultural Commissioner’s office receives annual subventions from CDFA to offset the local cost of enforcement and inspection activities of certain state-mandated programs. Cooperative Agreement No. 25-0553-000-SA provides funding for Humboldt County’s Apiary Protection Program for the period beginning Jan. 1, 2026, and ending June 30, 2027.

 

As of Jan. 1, 2026, every person that is the owner, broker, or is in possession of an apiary that is located within the state is required to register with the County Agricultural Commissioner (CAC) the number of colonies in each apiary that is owned or possessed by the person and the location of each apiary. Registration and fee payment is completed online through the BeeWhere software program. Fees for apiary registration can be found in the Agricultural Commissioner’s schedule of fees on the Commissioner’s webpage. CAC staff shall assist beekeepers and brokers utilizing the BeeWhere software program to register or pay fees, provide outreach to beekeepers and brokers related to apiary registrations, as well as verify, and monitor beekeepers and brokers registrations. Humboldt CAC will be paid $50 for each beekeeper registered with the county. CAC staff will also conduct inspection activities that include follow up inspections that may stem from incidental observations by CAC staff during regular courses of work that warrant an additional inspection, new hive locations noted in BeeWhere, or by receiving a complaint related to apiary registration or apiary health/issues. CAC staff will also provide oversight of disposal of contaminated hives, combs, appliances, colonies, and contents.

 

The waiver from the provisions of the Nuclear Free Ordinance is requested since the State of California will not modify its cooperative agreements to accommodate local ordinances. This agreement is before your Board after the start date due delays in receiving the agreement from the State.

Narrative Explanation of Financial Impact:

Cooperative Agreement No. 25-0553-000-SA provides $2,991.95 for activities related to the Humboldt County Apiary Protection Program for the period beginning Jan. 1, 2026, and ending June 30, 2027. The attached supplemental budget reflects the changes in revenue and expenditure accounts in Fund 1100, Budget Unit 261 - Agricultural Commissioner for remainder of FY 2025-26 in the amount of $1,000. The FY 2026-27 will be included in the upcoming annual budget cycle. Payment is made in arrears to Humboldt County based on quarterly invoices and upon meeting contractual requirements.

 

STAFFING IMPACT:

There is no impact on staffing.

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the agreement and supplemental budget. However, that is not recommended as the department would not be reimbursed for activities associated with the state-mandated program.
