RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve the attached Daily SWAP Standard Agreement (Attachment 1); and
2. Authorize Sheriff William Honsal, Correctional Captain or designee to execute the agreement on behalf of the department; and
3. Authorize Sheriff William Honsal, Correctional Captain or designee to execute any amendments to the agreement if approved in advance by County Counsel, Risk Management and the County Administrative Office; and
4. Approve allowing the authorizations in recommendations #2 and #3 above to remain in effect during the term of office and any subsequent terms of office for Sheriff William Honsal, including subsequent renewals, amendments, extensions, or addendums to the agreement.

DISCUSSION:
SWAP is designed to allow offenders sentenced to serve time in county jail to participate in a work program in lieu of incarceration. This allows offenders to be held accountable for their actions by serving their sentence, while also allowing them to maintain families and employment.
The SWAP program operates an agricultural farm in Fortuna that raises pigs, cows, chickens, and grows vegetables throughout the year. The livestock and vegetables produced at the farm are processed for the Correctional Facility to help offset food costs. SWAP operates a wood lot in Eureka where donated wood is processed then sold to the Senior Resource Center at a reduced cost. The program also provides landscaping services to county facilities and other municipalities for a fee.
As costs have escalated for the program due to inflation throughout all markets, the need to generate revenue is even more vital to the continued success of the program. The Daily SWAP Agreement allows for those assigned to the SWAP program, under the supervision of trained correctional staff, to perform landscaping operations for other county departments and municipalities throughout the county for revenue. The use of the Daily SWAP Agreement will allow a valuable program, that serves both the interests of the county and the community, to continue to operate.
A standard agreement for the landscaping services has been approved by County Counsel and Risk (attachment 1). In order to provide efficiency and timeliness, the SWAP program is requesting the Board approve the agreement as to form and provide Sheriff Honsal, Correctional Captain or their designees with the authority to sign this agreement without having to return to the Board of Supervisors each time.

Narrative Explanation of Financial Impact:
The daily rate is established annually as part of the county fee schedule. The current rate is $717 for an 8-hour day to cover the cost of the Correctional Deputy supervising the work crew plus fuel and equipment. The number of daily contracts varies from year to year and is dependent on the number of SWAP participants available to perform the work. As the revenue is unpredictable, a conversative estimate of $2,500 was budgeted in Fiscal Year 2026-27 due to the prior year being a rather low year for daily contracts. All revenue earned will help offset the General Fund contribution for the SWAP program.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board of Supervisors may choose not to approve the recommendations; however, this is not recommended as agreements like this will allow a vital program that serves the county and the community to continue to operate.
