RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

 

1.                     Authorize the Chair of the Board to execute agreements with Blue Lake, Ferndale, Fortuna, Garberville, Redway, Rio Dell and Samoa Fire Protection Districts, and Fieldbrook and Orleans Community Services Districts for revenue-sharing of the county’s Fiscal Year 2020-21 Proposition 172 (Prop 172) funding;

2.                     Direct the Clerk of the Board to submit one executed copy of the agreement to the County Administrative Office for processing;

3.                     Approve the attached Supplemental Budget in fund 1100 budget unit 199 Contributions Other to carry forward Prop 172 allocations to fire districts approved in fiscal year (FY) 2019-20 into FY 2020-21 (4/5 vote required);

4.                     Authorize the Auditor-Controller to tender FY 2019-20 Prop 172 allocations to Fire Districts as approved by your Board on Jul. 7, 2020; and

5.                     Approve and authorize the County Administrative Officer, or a designee thereof, to execute any and all future agreements regarding the allocation of Prop 172 to local fire districts following Board approval of the fire district allocations.

DISCUSSION:

Prop 172 of 1993 enacted a one-half cent sales tax statewide, dedicated to public safety purposes.  It was intended as partial compensation to counties and cities for property tax revenue that was shifted from local government to the State Education Revenue Augmentation Fund (ERAF).  In October 2005, the Board of Supervisors voted to contribute Prop 172 funding to the recognized fire districts in the county.

 

The Fire Chiefs Association provided the county with an allocation formula for distribution of 2.0 percent of the Prop 172 revenue between the 23 fire districts. County Administrative Office staff prepared draft agreements with each fire district, based upon the fire chiefs’ allocation formula.  The Blue Lake, Ferndale, Fortuna, Garberville, Redway, Rio Dell and Samoa Fire Protection Districts, and Fieldbrook and Orleans Community Services Districts have returned signed copies of their revenue-sharing agreements to the county. 

 

The following revenue-sharing agreements have not yet been returned to the County Administrative Office: Arcata, Humboldt, Kneeland, Loleta, Myers Flat, Petrolia, Telegraph Ridge, Whitethorn, and Willow Creek Fire Protection Districts, Shelter Cove Resort Improvement District (RID) #1, and Carlotta, Miranda and Orick Community Services Districts.

 

On July 7, 2020, your Board authorized the Chair of the Board to execute agreements with the Arcata, Blue Lake, Samoa, Ferndale, Fortuna, Garberville, Humboldt No. 1, Kneeland, Loleta, Myers Flat, Petrolia, Redway, Rio Dell, Willow Creek and Telegraph Ridge Fire Protection Districts; Fieldbrook, Carlotta, Miranda, Orick and Orleans Community Services Districts for revenue-sharing of the county's FY 2019-20 Proposition 172 (Prop 172) funding. Bringing these contracts to the Board on July 7 caused the effective date to be after the end of the term (June 30, 2020), causing payments to not be disbursed in FY 2019-20 as intended. Staff recommend those funds be carried forward and for your Board to authorize payments to be tendered to the fire districts as intended with the July 7 Board approval.

 

Finally,  Prop 172 agreements are standard and come before your Board in accordance with the allocations approved through the adopted budget. In order to provide for efficient processing and ability to tender prompt payment to the districts, staff recommends your Board authorize the County Administrative Officer, or a designee thereof, to execute any and all future agreements following approval of the fire district allocations.

 

FINANCIAL IMPACT:

Pursuant to the allocation formula developed by the Fire Chiefs’ Association, Arcata, Blue Lake, Samoa, Ferndale, Fortuna, Garberville, Humboldt, Kneeland, Loleta, Myers Flat, Petrolia, Redway, Rio Dell, Willow Creek, Whitethorn and Telegraph Ridge Fire Protection Districts, and Fieldbrook, Carlotta, Miranda, Orick, Orleans and Weott Community Service Districts, and Shelter Cove Resort Improvement District (RID) will receive the following percentages of total county Proposition 172 revenue:

These percentages represent approximately $45,288 of the $236,204 expected to be allocated to the fire districts during FY 2020-21. These funds are currently budgeted in Fund 1100, Budget Unit 199 (Contributions to Other Funds) for FY 2020-21.

 

Approximately $201,663 of the $211,932 is expected to be allocated to the fire districts for the FY 2019-20 agreements. Given funds were not dispersed in FY 2019-20 as budgeted, funds remain available in 1100 fund balance for allocation in FY 2020-21.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the revenue-sharing agreements for the county’s FY 2020-21 Prop 172 funding. This is not recommended as it would leave fire districts with reduced resources.
