RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Waive the requirements of the Humboldt County Nuclear-Free Ordinance with regard to the attached grant agreement with California Department of State Hospitals;

2.                     Approve, and authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute, the attached grant agreement with the California Department of State Hospitals regarding the development and implementation of local solutions that are designed to reduce the number of individuals with serious mental illness arrested or incarcerated for behavior connected to their illness, and the number of felony incompetent to stand trial commitments, within Humboldt County for the period of January 1, 2024, through December 31, 2028;

3.                     Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached grant agreement with the California Department of State Hospitals, after review and approval by County Counsel, Risk Management and the County Administrative Office;

4.                     Direct the Clerk of the Board to provide the Department of Health and Human Services - Contract Unit with one (1) fully executed certified copy of the Board Order related to this item.

DISCUSSION:

The attached grant agreement with the California Department of State Hospitals will allow the Humboldt County Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”) to receive up to Five Hundred Thousand Dollars ($500,000.00) for the purpose of coordinating, participating in and facilitating a collaborative community stakeholder workgroup comprised of representatives from the Humboldt County Superior Court, the Humboldt County Public Defender’s Office, the Humboldt County District Attorney’s Office, the Humboldt County Sheriff’s Office and the Humboldt County Probation Department that is responsible for  developing and implementing local solutions, including, without limitation, planning for care court, coordinating treatment, discussing housing options and planning for rearrest and/or reentry into diversion programs, that are designed to reduce the number of individuals with serious mental illness arrested and incarcerated for behavior connected to their illness, and the number of felony incompetent to stand trial commitments, within Humboldt County, for the period of January 1, 2024, through December 31, 2028.  It should be noted that the attached grant agreement with the California Department of State Hospitals comes to the Board of Supervisors after the start date thereof due to inadvertent delays that occurred during the contract development process.

 

Accordingly, DHHS - Behavioral Health recommends that the Board of Supervisors approve, and authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute, the attached grant agreement with the California Department of State Hospitals regarding the development and implementation of local solutions that are designed to reduce the number of individuals with serious mental illness arrested and incarcerated for behavior connected to their illness, and the number of felony incompetent to stand trial commitments, within Humboldt County for the period of January 1, 2024, through December 31, 2028.  It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to, and any other agreements, certifications, attestations and documents directly associated with, the attached grant agreement with the California Department of State Hospitals, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the development and implementation of local solutions that are designed to achieve the above-referenced goals and objectives.

The attached grant agreement with the California Department of State Hospitals will allow DHHS - Behavioral Health to receive up to Five Hundred Thousand Dollars ($500,000.00) during the period of January 1, 2024, through December 31, 2028.  In no event will the amounts received by DHHS - Behavioral Health pursuant to the terms and conditions of the attached grant agreement with the California Department of State Hospitals exceed Fifty Thousand Dollars ($50,000.00) for fiscal year 2023-2024, One Hundred Thousand Dollars ($100,000.00) per fiscal year for fiscal years 2024-2025 through 2027-2028 and Fifty-Thousand Dollars ($50,000.00) for fiscal year 2028-2029. 

 

Expenditure appropriations related to the attached grant agreement with the California Department of State of Hospitals have been included in approved fiscal year 2023-2024 budget for DHHS-Behavioral Health Administration budget unit 1170-424.  Approval of the attached grant agreement with the California Department of State Hospitals will not impact the Humboldt County General Fund.

 

STAFFING IMPACT:

Approval of the attached grant agreement with California Department of State Hospitals will not impact current staffing levels.

 

OTHER AGENCY INVOLVEMENT:

None

 

ALTERNATIVES TO STAFF RECOMMENDATIONS:

The Board may choose not to approve the attached grant agreement with the California Department of State Hospitals regarding the development and implementation of local solutions that are designed to reduce the number of individuals with serious mental illness arrested or incarcerated for behavior connected to their illness, and the number of felony incompetent to stand trial commitments, within Humboldt County.  However, this alternative is not recommended since it would not allow DHHS - Behavioral Health to obtain funding that would be used to support the provision of necessary mental health services to individuals who have been, or are at risk of being, found incompetent to stand trial.
