RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Chair of the Board to execute, the attached memorandum of understanding with Mariane Gilbert regarding payment of the costs and expenses associated with the provision of non-emergency medical care services;
2. Authorize the Department of Health and Human Services - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached memorandum of understanding with Mariane Gilbert, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached memorandum of understanding with Mariane Gilbert to the Department of Health and Human Services - Contract Unit for further processing.

DISCUSSION:
Pursuant to Section 77061(d) of Title 22 of the California Code of Regulations, the County of Humboldt’s psychiatric health facility, Sempervirens, is required to always have a physician on-call for the provision of non-emergency physical health care. On August 8, 2021, the County of Humboldt entered into a professional services agreement with Mariane Gilbert regarding the provision of non-emergency medical care services for patients at Sempervirens for the period of July 1, 2021 through June 30, 2022. Due to inadvertent oversight, the monthly invoice for May 2022 was not submitted until July 13, 2022. Upon receipt of delayed invoices and due to additional non-emergency medical care services the contract cap was exceeded and an amendment to increase the cap was unable to be completed prior to the expiration of the agreement.
The purpose of the attached memorandum of understanding is to document Mariane Gilbert’s provision of additional non-emergency medical care services during fiscal year 2021-2022, and to provide for payment of such services. Accordingly, the Department of Health and Human Services - Behavioral Health (“DHHS - Behavioral Health”) recommends that the Board approve, and authorize the Chair of the Board to execute, the attached memorandum of understanding with Mariane Gilbert regarding payment of the costs and expenses associated with the provision of non-emergency medical care services. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached memorandum of understanding with Mariane Gilbert, after review and approval by County Counsel, Risk Management, and the County Administrative Office, in order to avoid any unnecessary delays in the payment of the costs and expenses associated with the provision of non-emergency medical care services at Sempervirens.
FINANCIAL IMPACT:
The attached memorandum of understanding with Mariane Gilbert has a maximum amount payable of Two Thousand Seven Hundred Sixty Dollars ($2,760.00). Expenditure appropriations related to the attached memorandum of understanding have been included in the approved fiscal year 2022-2023 budget for DHHS - Behavioral Health Administration budget unit 1170-424. Funding for the attached memorandum of understanding with Mariane Gilbert is made available through Medi-Cal financial participation revenues received by DHHS - Behavioral Health. As a result, approval of the attached memorandum of understanding with Mariane Gilbert will not impact the Humboldt County General Fund.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by protecting vulnerable populations, creating opportunities for improved safety and health and providing community-appropriate levels of services.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose to not approve the attached memorandum of understanding with Mariane Gilbert regarding payment of the costs and expenses associated with the provision of non-emergency medical care services for patients at Sempervirens Psychiatric Health Facility. However, this alternative is not recommended since it would not allow DHHS - Behavioral Health to pay Mariane Gilbert for the additional non-emergency medical care services provided.
