RECOMMENDATION(S):

Recommendation

That the Board of Supervisors:

1.                     Approve the Right of Way Contract for a Temporary Construction Easement (TCE) behind the sidewalk of the Sheriff’s exit driveway;

2.                     Authorize the Chair of the Board to sign two originals of the TCE; and

3.                     Direct the Clerk of the Board to return two originals to Public Works, Real Property - for transmittal to Caltrans

DISCUSSION:

Caltrans has a project to construct Americans with Disability Act (ADA) compliant sidewalks and driveways along Fifth Street in Eureka. 

 

The Correctional Facility exit driveway in the vicinity of 5th and J Street does not meet accessibility requirements for pedestrians.  Caltrans proposes to address accessibility compliance by constructing site improvements per the attached drawing (Attachment No. 1 - Construction Detail).  Public Works and ADA Compliance staff have reviewed the proposed work, provided commentary, and will continue to work with Caltrans during construction of the proposed improvements towards ensuring compliance with the ADA.

 

Caltrans is requesting the county to execute a Right of Way Contract in the form of a TCE,  consisting of 10 foot deep by 33 foot wide strip of land behind the sidewalk, within the lands of the county and its driveway. The location of the TEC is shown on Attachment No. 2 - Right of Way Appraisal Map. Caltrans will need this strip to allow workers a safe location to mobilize and thus stay outside of the road when replacing said sidewalk.   Caltrans will submit consideration in the amount of $1,850 as described in Attachment No. 3 - Valuation Summary Statement.

 

A review with the Sheriff’s Department indicates no issues with the TCE and one (1) week temporary ramp closure to accommodate construction.  Construction is planned for the Summer of 2022 and will take approximately 1 week to accomplish.  Notification will be made to the Sheriff’s Department prior to commencement of work so that they may divert egress from 5th Street to 4th Street.

 

Staff recommends your board approve the attached Temporary Construction Easement.

 

FINANCIAL IMPACT:

The General Fund (1100888) will receive the revenue in the amount of $1,850.

ALTERNATIVES TO STAFF RECOMMENDATIONS:                     

The Board could choose not to approve the TCE, however this is not recommended.  Not approving the TCE will prevent Caltrans from improving accessibility to the sidewalk and will therefore delay their project.  It will force an Eminent Domain process to resume work, thus creating negative publicity, time and costs for the county.
