Recommendation
That the Board of Supervisors:
1. Adopt the following corrected resolutions for Tiny House Village Ordinance, Emergency Housing Village Ordinance, Commercial Residential Ordinance, Zoning Updates Ordinance, Supportive and Transitional Housing Ordinance, Emergency Shelter Ordinance, and Outdoor Lighting Ordinance; and
2. Direct Planning and Building Department staff to transmit the following coastal ordinances (Tiny House Village Ordinance, Emergency Housing Village Ordinance, Commercial Residential Ordinance, Zoning Updates Ordinance, Supportive and Transitional Housing Ordinance, Emergency Shelter Ordinance, and Outdoor Lighting Ordinance), including all necessary supporting documentation, to the California Coastal Commission as an amendment to the certified Local Coastal Program for their review and certification in accordance with Public Resources Code Section 30514.

DISCUSSION:
Project Location: All coastal unincorporated areas of Humboldt County.
Present General Plan Land Use Designation: All land use designations.
Present Zoning: All zoning districts.
Environmental Review: The proposed ordinance amendments are exempt from environmental review under Section 15251(f), Exemption for Certified State Regulatory Programs of CEQA Guidelines.
State Appeal: Changes proposed to the Local Coastal Program must receive final certification from the California Coastal Commission before they become effective.
Executive Summary:
As part of the Local Coastal Plan Amendment, coastal ordinances need to be certified by the California Coastal Commission (CCC) before the ordinances can be effective in the coastal portions of the unincorporated county.
Per the CCC, the Board of Supervisors needs to direct Planning and Building Department staff to transmit the following coastal ordinances (Tiny House Village Ordinance, Emergency Housing Village Ordinance, Commercial Residential Ordinance, Zoning Updates Ordinance, Supportive and Transitional Housing Ordinance, Emergency Shelter Ordinance, and Outdoor Lighting Ordinance), including all necessary supporting documentation, to the California Coastal Commission as an amendment to the certified Local Coastal Program for their review and certification in accordance with Public Resources Code Section 30514.
The CCC will not review or start the certification process for these seven ordinances until the resolutions are amended to include the following actions by the Board of Supervisors:
1. Find that the proposed amendments to the Coastal Zoning Regulations conform to and appropriately carry out the policies of each of the Humboldt County’s six Coastal Plans and Chapter 3 of the Coastal Act, and further find that the proposed Zoning Regulations will be carried out in accordance with the Coastal Act; and
2. Find that the changes to the Coastal Zoning Regulations will become effective only upon certification by the California Coastal Commission; and
3. Certify that this amendment is intended to carry out the provisions of the local coastal program adopted by the County and certified by the California Coastal Commission per public resources code 30510.
4. Direct Planning and Building Department staff to transmit the ordinance (25- __), including all necessary supporting documentation, to the California Coastal Commission as an amendment to the certified Local Coastal Program for their review and certification in accordance with Public Resources Code Section 30514.
The attached resolutions are amended to include the above language, shown in underline text, and any deletions are shown in strikethrough text.
SOURCE OF FUNDING:
General funds (1100)
FINANCIAL IMPACT:
Staff costs and other expenses related to work on the coastal ordinance, and preparation and review of this staff report total approximately $11,400. The staff positions to complete this work are filled and allocated and are included in the General Fund contribution to the Long Range Planning unit 1100-282.
STAFFING IMPACT:
None.
OTHER AGENCY INVOLVEMENT:
California Coastal Commission.
ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board can choose not to adopt the corrected resolutions, but this would result in the California Coastal Commission staff not processing these ordinances for certification.
