RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve and authorize the Chair of the Board to execute the attached professional services agreement with Fortuna Seventh-Day Adventist Church regarding the provision of monitoring services related to the Humboldt Alcohol Recovery Treatment Program in the amount of $27,000 for the period of July 1, 2024 through June 30, 2029;
2. Authorize the Department of Health and Human Services ̶ Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with Fortuna Seventh-Day Adventist Church, after review and approval by County Counsel, Risk Management and the County Administrative Office; and
3. Direct the Clerk of the Board to return one (1) fully executed original copy of the attached professional services agreement with Fortuna Seventh-Day Adventist Church to the Department of Health and Human Services ̶ Contract Unit for further processing.

DISCUSSION:
The Humboldt County Department of Health and Human Services ̶ Behavioral Health (“DHHS ̶ Behavioral Health”) has a mission to provide quality substance use disorder services based upon current best practices. The intent of the services provided by Fortuna Seventh-Day Adventist Church through the Humboldt Alcohol Recovery Treatment Program is to eliminate the behavior of driving under the influence of drugs and/or alcohol. The Humboldt Alcohol Recovery Treatment Program further educates and counsels participants regarding the harmful consequences of substance abuse and driving under the influence of drugs and alcohol for the individual as well as the community at large.
The State of California requires counties to designate providers for Driving Under the Influence Programs. The Humboldt Alcohol Recovery Treatment Program is authorized by DHHS ̶ Behavioral Health, and is licensed and operated under regulations promulgated by the California Department of Health Care Services. Since 1991, Fortuna Seventh-Day Adventist Church has been a designated provider of the Humboldt Alcohol Recovery Treatment Program, fulfilling the State requirement to provide this service.
Fortuna Seventh-Day Adventist Church provides alcohol and other drug education and counseling services for persons whose license to drive has been administratively suspended or revoked through the Humboldt Alcohol Recovery Treatment Program. The Humboldt Alcohol Recovery Treatment Program assists clients in recognizing their level of chemical dependency, acquaints them with life problems associated with chemical dependency and aids in their recovery. Fortuna Seventh-Day Adventist Church has demonstrated competence in alcohol treatment that furthers DHHS - Behavioral Health’s mission throughout the community.
Pursuant to California law, DHHS - Behavioral Health is required to monitor the services provided through the Humboldt Alcohol Recovery Treatment Program in order to ensure compliance with any and all applicable local, state and federal laws, regulations and standards. The attached professional services agreement with Fortuna Seventh-Day Adventist Church sets forth each party’s rights and responsibilities regarding the provision of monitoring services related to the Humboldt Alcohol Recovery Treatment Program for the period of July 1, 2024 through June 30, 2029. It should be noted that the attached professional services agreement with Fortuna Seventh-Day Adventist Church comes to the Board after the start date thereof due to inadvertent delays that occurred during the contract development process.
Accordingly, DHHS - Behavioral Health recommends that the Board approve, and authorize the Chair of the Board to execute the attached professional services agreement with Fortuna Seventh-Day Adventist Church regarding the provision of monitoring services related to the Humboldt Alcohol Recovery Treatment Program for the period of July 1, 2024 through June 30, 2029. It is also recommended that the Board authorize the DHHS - Behavioral Health Director, or a designee thereof, to execute any and all subsequent amendments to the attached professional services agreement with Fortuna Seventh-Day Adventist Church, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of monitoring services related to the Humboldt Alcohol Recovery Treatment Program.
SOURCE OF FUNDING:
Behavioral Health Fund (1180-425)
FINANCIAL IMPACT:
Pursuant to the terms and conditions of the attached professional services agreement, Fortuna Seventh-Day Adventist Church is responsible for paying DHHS - Behavioral Health an annual monitoring fee not to exceed Five Thousand Four Hundred Dollars ($5,400) per fiscal year for the period of July 1, 2024 through June 30, 2029. The revenue related to the attached professional services agreement with Fortuna Seventh-Day Adventist Church has been included in the proposed fiscal year 2024-2025 budget for DHHS - Behavioral Health budget unit 1180-425. Approval of the attached professional services agreement with Fortuna Seventh-Day Adventist Church will not impact the Humboldt County General Fund.
STAFFING IMPACT:
Approval of the attached professional services agreement with Fortuna Seventh-Day Adventist Church will not impact current staffing levels.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board may choose not to approve the attached professional services agreement with Fortuna Seventh-Day Adventist Church regarding the provision of monitoring services related to the Humboldt Alcohol Recovery Treatment Program. However, this alternative is not recommended as there are no other Driving Under the Influence program providers in Humboldt County.
