RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and ratify the Public Works Director’s execution of, the attached Third amendment to the consultant services agreement with Lenders Construction Services, LLC regarding the provision of construction administration services for the Humboldt County Juvenile Hall Replacement Facility Construction Project; and
2. Authorize the Public Works Director, or a designee thereof, to execute any and all subsequent amendments to the consultant services agreement with Lenders Construction Services, LLC, after review and approval by County Counsel, Risk Management and the County Administrative Office.

DISCUSSION:
On October 6, 2015, the Humboldt County Board of Supervisors approved and executed the original consultant services agreement with Lenders Construction Services, LLC regarding the provision of construction administration services for the Humboldt County Juvenile Hall Replacement Facility Construction Project (“Juvenile Hall Replacement Project”). The original consultant services agreement with Lenders Construction Services, LLC had a maximum amount payable of Five Hundred Thirty Thousand Dollars ($530,000.00) for a period of eight hundred fifty (850) days.
On July 11, 2017, the Board approved the first amendment to the consultant services agreement with Lenders Construction Services, LLC in order to expand the scope of services set forth therein, increase the maximum amount payable thereunder to Six Hundred Thousand Dollars ($600,000.00) and extend the term thereof through anticipated completion of the ongoing Juvenile Hall Replacement Project for a total of one thousand two hundred (1,200) days.
On February 19, 2019, the Board ratified the second amendment to the consultant services agreement with Lenders Construction Services, LLC in order to expand the scope of services set forth therein, increase the maximum amount payable thereunder to One Million Thirty-One Thousand Eight Hundred Dollars ($1,031,800.00) and extend the term thereof through anticipated completion of the ongoing Juvenile Hall Replacement Project for a total of one thousand five hundred sixty-five (1,565) days.
The attached third amendment to the consultant services agreement with Lenders Construction Services, LLC will further expand the scope of construction administration services set forth therein, increase the maximum amount payable thereunder and extend the term thereof for an additional three hundred sixty-five (365) days in order to allow for the provision of such services during the remainder of the anticipated construction period.
Accordingly, staff recommends that the Board approve, and ratify the Public Works Director’s execution of the attached third amendment to the consultant services agreement with Lenders Construction Services, LLC regarding the provision of construction administration services for the Juvenile Hall Replacement Project. It is also recommended that the Board authorize the Public Works Director, or a designee thereof, to execute any and all subsequent amendments to the consultant services agreement with Lenders Construction Services, LLC, after review and approval by County Counsel, Risk Management and the County Administrative Office, in order to avoid any unnecessary delays in the provision of needed construction administration services.
FINANCIAL IMPACT:
Approval of the attached third amendment to the consultant services agreement with Lenders Construction Services, LLC will increase the County of Humboldt’s existing financial obligation for the construction administration services provided thereunder by One Hundred Ninety-Four Thousand Eighty-Eight Dollars ($194,088.00) for a total maximum amount payable of One Million Two Hundred Twenty-Five Thousand Eight Hundred Eighty-Eight Dollars ($1,225,888.00).
Additional funding related to the attached third amendment to the consultant services agreement with Lenders Construction Services, LLC will be obtained through a supplemental budget request contained in the mid-year budget report.
STRATEGIC FRAMEWORK:
The recommended actions support the Board of Supervisors’ Strategic Framework by providing for and maintaining infrastructure.

ALTERNATIVES TO STAFF RECOMMENDATIONS:
The Board could choose not to approve, and ratify the Public Works Director’s execution of, the attached third amendment to the consultant services agreement with Lenders Construction Services, LLC regarding the provision of construction administration services for the Juvenile Hall Replacement Project. This alternative is not recommended because it would delay and complicate the oversight of the ongoing Juvenile Hall Replacement Project.
