RECOMMENDATION(S):
Recommendation
That the Board of Supervisors:
1. Approve, and authorize the Department of Health and Human Services - Public Health Director, or a designee thereof, to execute, the attached memorandum of understanding with CDPH regarding the STD 340B drug pricing program; and
2. Authorize the Department of Health and Human Services - Public Health Director, or a designee thereof, to execute any and all subsequent amendments, and any other agreements, certifications, attestations and documents directly associated with, CDPH STD 340B memorandums of understanding, after review and approval by County Counsel, Risk Management, and the County Administrative Office; and
3. Direct the Clerk of the Board to provide the Department of Health and Human Services - Public Health Contract Unit with one fully executed, certified copy of the Board order related to this item.

DISCUSSION:
Section 340B of the Public Health Service Act (PHSA) 42 United States Code (U.S.C.) 256b instructs the Secretary of Health and Human Services to enter into agreements with manufacturers of covered outpatient drugs under which the amount to be paid to manufacturers by certain statutorily-defined covered entities does not exceed the 340B ceiling price. The 340B program purpose is to stretch scarce federal resources as far as possible, reaching more eligible patients and providing more comprehensive services. It is administered by the United States Health and Resources Services Administration (HRSA) Office of Pharmacy Affairs.
